For reasons Floridians are yet to understand, there are comparably more drunk driving car accidents in Florida than the rest of the United States. From 2003 through 2012, nearly 9,000 people died from alcohol-related auto accidents in Florida. In the same time frame, Florida averaged 8 wrongful deaths from DUI accidents per 100,000 people for the 21 – 34 age range, while the national average for the same age range was only 6.7 per 100,000 (source: The Centers for Disease Control and Prevention, CDC.gov). When discussing drinking and driving wrongful death car crashes, it is important to understand that, under Florida law, drinking and driving refers to a driver having a blood alcohol concentration (BAC) over .08%. Under the Florida DUI law, a driver is considered legally “drunk” if his or her blood alcohol concentration exceeds .08%.
